Statement of Claim Drafting in Ontario

A Statement of Claim starts a civil action. The court that hears the matter depends on the dollar value: Small Claims up to $35,000, Superior Court Simplified Procedure up to $200,000, and ordinary Superior Court above that. We Draft It auto-fills all three forms.

Superior Court — Form 14A

The standard Statement of Claim under Rule 14.03 of the Rules of Civil Procedure. Used for claims over $200,000 or any claim that does not fit Simplified Procedure. The claim sets out the parties, the cause of action, the material facts, and the relief sought.

Simplified Procedure — Form 14E (Rule 76)

For claims between $35,000 and $200,000, Rule 76 cuts discovery, examinations, and trial length. Form 14E looks like Form 14A with the simplified-procedure endorsement on the back. Most of these settle before trial.

Small Claims — Form 7A

Form 7A is the Plaintiff's Claim under O. Reg. 258/98 (Rules of the Small Claims Court). Used for claims up to $35,000. Paralegals and self-represented litigants file these directly with the court office.

Frequently asked questions

What is the limitation period?
Two years from the date the claim was discoverable under s. 4 of the Limitations Act, 2002, with statutory exceptions for minors, persons under disability, and specific causes of action (e.g. demand obligations under s. 5(3)).
Can a paralegal sign a Statement of Claim?
In Small Claims, yes. In Superior Court (Form 14A or 14E), no — that is outside the paralegal scope under LSO By-Law 4. A lawyer signs the Superior Court claim.
