Ontario Superior Court of Justice — Rules of Civil Procedure

Service (Rule 16)

Frequently asked questions
- Where do I file an SCJ claim?
- At the Superior Court of Justice registry in the judicial region where the cause of action arose, where the defendant resides, or in Toronto (Commercial List, Estates List, etc.). The Notice of Appearance directs follow-on filings to the right courthouse.
- What is the small-claims monetary limit?
- $35,000 plus interest and costs, set by O. Reg. 258/98. Above that, the claim goes to the Superior Court — Simplified Procedure under Rule 76 up to $200,000, ordinary procedure above $200,000.
