The Small Claims Court is a branch of the Superior Court of Justice that hears civil claims up to $35,000. Procedure follows O. Reg. 258/98 — the Rules of the Small Claims Court. Paralegals can represent parties throughout the process under LSO By-Law 4.
Form 7A — Plaintiff's Claim. Sets out the parties, the amount claimed, the reason for the claim, and the date the claim arose. Filed at the Small Claims Court registry in the judicial region where the defendant lives or where the cause of action arose. Filing fee is $108 for represented parties, $108 for self-represented (2026 fee schedule).
Form 9A — Defendant's Claim and Defence. Combines the defence with any counterclaim. Twenty days from the date of service to file.
Form 8A — Affidavit of Service (sworn). Form 8B — Lawyer or Paralegal's Certificate of Service (licensee-signed, no commissioner). Both prove that the claim, defence, or other document was served on the other party.
Form 18A — Summons to Witness. Witness List filed at the settlement conference (Rule 13.02) and 14 days before trial (Rule 17.04). Auto-fill all of these on We Draft It.
